Disclaimer:
On Dec, 1, 2022, the Office for Civil Rights (OCR) at the U.S. Department of Health and Human Services (HHS) issued a Bulletin related to legal obligations when hospitals or health systems use online tracking technologies.  That Bulletin can be found here:  https://www.hhs.gov/hipaa/for-professionals/privacy/guidance/hipaa-online-tracking/index.html.  In July 2023, the OCR sent letters to approximately 130 hospital systems and telehealth providers, “strongly encourag[ing]” them “to review” and “take actions” in light of the Bulletin and warning them that the agency is “closely watching developments in this area.”  https://perma.cc/H2HJ-367X.  There are also several ongoing class action lawsuits against hospital and health systems related to their use of tracking technologies.  On Nov.2, 2023, the American Hospital Association and others filed a lawsuit in the Northern District of Texas seeking to enjoin enforcement of the Bulletin.  Nevertheless, please consult your respective legal teams with any questions about this developing area.
